- Scope. These terms govern every service described on the Services page and provided by Philippe Lognoul, a freelance translator established in Switzerland, working under the brand By SaRo.
- Quotes and orders. Every service is the subject of a written, firm quote, valid for 30 days, which states the price excluding tax, the word count or billing unit, the delivery date and the service chosen.
The contract is formed when the quote is accepted in writing, by email or purchase order.
Any change to the document or the request after acceptance gives rise to a supplementary quote. - Deadlines. The deadline runs from receipt of the complete document, in a usable format, and acceptance of the quote.
It is expressed as a date and time.
Any delay attributable to the client, such as an incomplete document or a late reply to a question, extends it accordingly. - Delivery. The translation is delivered by email or through the portal designated by the client, in the format of the source document unless otherwise agreed, together with a delivery note.
The statement of accuracy is provided on request, in signed form. - Prices and payment. Prices are stated excluding tax; the invoice carries no Swiss VAT, as the provider is exempt from liability for Swiss VAT (Article 10 of the Swiss Federal Act on Value Added Tax).
Invoices are payable within 30 days of their date, by bank transfer, in euros or Swiss francs, with no discount for early payment.
The minimum charge is EUR 60.00 per order.
If payment is not made by the due date, statutory default interest accrues without formal notice. - Confidentiality. Every document received is treated in strict confidence, under the conditions described on the Privacy page, which forms part of these terms.
- Withdrawal. A consumer resident in the European Union may withdraw without giving any reason within 14 days of accepting the quote, simply by email.
A consumer who asks for the service to begin before that period ends acknowledges losing this right once the service has been fully performed; if they withdraw before then, only the part already performed is invoiced.
The model withdrawal form is attached to every quote sent to a private individual. - Complaints. Any complaint about the quality of the service must be made in writing within 15 days of delivery, identifying the passages in dispute.
The provider will correct, free of charge, anything that needs correcting.
A complaint does not suspend payment of the undisputed part. - Liability. The provider’s liability is limited to the amount, excluding tax, of the service concerned.
It does not cover indirect loss, loss of profit, the consequences of using the translation for purposes other than those stated when the order was placed, or errors originating in the source text.
These limitations do not apply in cases of wilful misconduct or gross negligence, or where a mandatory provision excludes them. - Ownership. The translation becomes the property of the client upon payment of the invoice in full.
The provider retains the right to keep, solely for the client’s own files, the translation memory and terminology built up. - Governing law and jurisdiction. These terms are governed by Swiss law.
This choice does not deprive consumers of the protection afforded to them by the mandatory provisions of the law of their habitual residence.
The place of jurisdiction is the provider’s domicile, in the Canton of Vaud, subject to any mandatory place of jurisdiction.
